1. Eligibility:
The Aerial Photo Contest (the “"Promotion") is open only to individuals who are 18 years of age or older at the time of entry and are legal residents of the United States. Employees of Environmental Data Resources, Inc. or other companies associated with the Promotion, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Void where prohibited or restricted by law.
By participating in the Promotion, entrants agree to be bound by the decisions of the Sponsor (defined below). The Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning the Official Rules or the Promotion and the Sponsor’s decisions concerning such disputes shall be final. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY THE SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
2. Sponsor:
The Promotion is sponsored by Environmental Data Resources, Inc., 440 Wheelers Farms Road, Milford, CT 06461 (the "Sponsor").
3. Agreement to Official Rules:
Participation in the Promotion constitutes an entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. Description; Drawing:
The Promotion consists of (i) Photo Identification Contests (described below) and an iPad Drawing (described below)
The Photo Identification Contests consist of the Sponsor posting an aerial photograph (from time to time as determined by Sponsor in its sole discretion) and eligible entrants posting to commonground their submitted guesses of the name of the site or location depicted by the aerial photograph. The Sponsor is not responsible for submissions that are lost, delayed, incomplete or illegible. The first eligible entrant to submit to the Sponsor the correct name of the site or the location depicted by such aerial photograph shall be the winner of that particular Photo Identification Contest (determined by when the submissions are received by the Sponsor and subject to the requirements herein). Winners of each Photo Identification Contests will be notified by email to the email account provided at the time of their submission of their entry in such Photo Identification Contest[p1] . Entrants must have a valid e-mail address and it is the entrant’s responsibility to update the Sponsor of any change in his/her e-mail address. Three attempts will be made to contact the winner of the Photo Identification Contest at the registered email address. If the winner cannot be reached via registered email address, then the winner will no longer be eligible to win the prize (described below) and the next entrant who had submitted the correct name of the site or location depicted by the aerial photograph in the applicable Photo Identification Contest will be deemed to be the winner of such such Photo Identification Contest (determined by when the submissions are received by the Sponsor and subject to the requirements herein).
Each winner of a Photo Identification Contest will receive a prize of (i) a $25 Amazon Gift Card and (ii) an entry into the iPad Drawing to be held at the end of the Promotion (the end of the Promotion to be determined by the Sponsor in its sole discretion). At the end of the Promotion, the Sponsor will select one (1) name in a random drawing of winners of the Photo Identification Contests. The name selected in the iPad Drawing will, subject to the terms herein described, receive an iPad (16GB, WiFi model) The winner of the iPad Drawing will be notified by email to the email account last provided to the Sponsor. Entrants must have a valid e-mail address and it is the entrant’s responsibility to update the Sponsor of any change in his/her e-mail address. Three attempts will be made to contact the winner of the iPad Drawing at the registered email address. If the winner cannot be reached via registered email address, then the winner will no longer be eligible to win the iPad, and the Sponsor will select an alternate name in his/her place at random.
If any specified prize described herein becomes unavailable due to unforeseen circumstances, the Sponsor may substitute a prize of like or equal value.
All prizes are provided “as is,” and the Sponsor makes no warranty, representation or guarantee regarding any prize, including but not limited to its quality, condition, merchantability or fitness for a particular purpose.

5. Requirements of Potential Winners:
Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within ten (10) days of being notified. Failure to sign and return the Affidavit/Release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize. By participating and accepting a prize, winner agrees to provide his/her name, address, voice, photograph, videotape and any other likeness as requested by Sponsor for advertising or publicity purposes and to the use of such material and statements made by or attributed to him/her relating to the Sponsor or the Promotion, and releases any and all rights to said use in any and all media without further compensation except where prohibited.
All winners are solely responsible for any taxes and/or fees, an all such additional costs that may be incurred.
6. General Conditions:
The Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion.
The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Promotion is subject to federal, state, and local laws and regulations and is void where prohibited or restricted. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
7. Release and Limitations of Liability:
By participating in the Promotion, entrants agree to release and hold harmless the Sponsor, its related companies, and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) inaccurate transmissions of or failure to receive entry information by the Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof; (d) errors in the administration of the Promotion or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
8. Disputes:
Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New Haven County, Connecticut. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Connecticut, without giving effect to any choice of law or conflict of law rules (whether of Connecticut or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Connecticut).
