Under a new policy just issued by the U.S. Small Business Administration, consultants conducting environmental due diligence on SBA-backed loans now have more streamlined—and in many ways, more robust—guidelines to follow. The environmental requirements are included as an important component of the SBA’s revisions to its standard operating procedure for lender and development company loan programs (SOP 50-10(5). To mitigate environmental risk, the SBA and its participating lenders have long required pre-purchase environmental due diligence on commercial real estate. Previous environmental requirements, however, were often criticized for being too vague or too onerous. The SBA sought to address this feedback by developing a more streamlined, prescriptive process for determining what level of environmental due diligence is warranted. Consultants working with lenders who make SBA 7(a) and 504 loans should become familiar with the new, more rigorous environmental guidelines, which take effect on June 15, 2008.
